Terms & Conditions of Use

Foreword

Welcome to www.ty-bolid.com (hereinafter referred to as “the Website”)! The present terms and conditions of use (hereinafter referred to as “TCU”) exclusively govern the sale of products on the Webshop TY BOLID. The customer can access the TCU at any moment via the Website. The customer is legally obliged to adhere to the terms and conditions of the TCU when placing an order, except under the circumstance that other terms and conditions apply in catalogs, stores or flyers.

Article 1. Subject

The present terms and conditions govern the sale of products available on the Website run by the company Mini Express Sarl, a company with a capital of € 10,000, located 2 Rue de l'Écusson, Espace Commerciale Oxygène Sud, 56120 Josselin, France, and licensed under the number with the Company register of Vannes, to all non-professional individuals over the age of 18, referred to hereinafter as the Customer.

Article 2. Customer account

All new customers must create a customer account, either at the moment of placing an order or beforehand in “My Account”. The customer must register a valid email address and choose a password to use each time they connect to the Website or each time a payment is made. After giving this information, the customer must fill out a form stating their name, year of birth, home address, phone number and email address.
The customer can desactivate his account at any moment by clicking on the tab "Contact us".

Article 3. Order

To place an order, the Customer can peruse the online catalogue and click on ‘Add to cart’ to select the product(s) of their choosing. The Customer must then choose the quantity they wish. It is possible to access the cart at any moment in order to review or delete one or more selected items. The customer can then click on ‘Continue shopping’ to go back to the online catalogue or ‘Place order’ to finish the transaction.

A summary page – corresponding to the order – will appear which will include information relating to the Customer, but also the order: billing address, delivery address (if different from the billing address), nature of the order, product price and quantity along with the shipping costs. The Customer can at this point choose his method of transport, along with the payment method, after ticking the box to accept the TCU.
 
At the end of the order, a confirmation email will be sent to the email address indicated in the customer details in the customer account, summarizing the details of the order (products, price etc). It is recommended that the Customer conserves the aforementioned email which will also contain the relevant invoice.

Article 4. Price

The product prices are indicated in Euros and are inclusive of any and all tax (VAT applicable at the date of the order), excluding transport costs. TY BOLID reserves the right to modify the product prices at any moment. The applicable rates are those in effect on the Website at the time of confirmation of the order.

Article 5. Products

The Products offered for sale are those that appear on the site www.ty-bolid.com the day the Website is viewed. The sale of the product is dependant on stock availability. The photographs illustrating the products are intended to be as accurate as possible; the actual product may vary from the photograph however. The customer can consult the description of each product to discover its main characteristics (colour, scale, manufacturer ...).

Article 6. Delivery

The package, along with the corresponding invoice, is delivered to the address indicated by the Customer in their customer account. Parcels are processed from Monday to Friday, excluding holidays. The average delivery time is 5 days. Delays can however arise at certain times (private sales, sales ...) but should not exceed 1 week, subject to normal shipping delays by the Post Office.

The price varies depending on the weight and number of items in the parcel.

The customer will receive his tracking information by email once the parcel has been sent. In case of any problems (delay, non-delivery…), it is recommended the customer log on to their account and sends us a message via the "Contact us" tab.

Article 7. Retraction delay

The customer has 7 days starting from the date of receipt of the order to exercise his right to retract his order. The return costs for the product(s) are at the expense of the customer. To exercise this right, the customer must notify TY BOLID by email at [email protected]  and await an email of acceptance concerning the return.

Article 8. Payment

Payment is due in full at the end of the order. Payment can be made online by credit card (Debit card, Visa, Mastercard) or Paypal. In case of payment default, incorrect address or other problems associated with the payment, TY BOLID reserves the right to block the Customer's order until the problem is resolved.

Article 9. Payment security

In order to ensure the security of payments, TY BOLID uses a security system in accordance with the encryption protocol SSL (Secure Socket Layer). The banking data is thus encrypted and therefore any sensitive data related to payment is protected. TY BOLID uses the secure payment service Systempay in connection with the BPA bank (Banque Populaire Atlantique). TY BOLID never has access to confidential information (card number, expiration date and encryption key) related to the credit card of the customer; only the secure payment platform Systempay and BPA bank have this information.

Article 10. Returns and exchanges

The customer has a period of 7 days following the receipt of a product to return an item. To exercise this right, the customer must notify TY BOLID by email at [email protected] and await an email accepting the return.

Items must be in perfect condition (new, clean and complete) and in the original packaging. The return costs are at the expense of the Customer. To be refunded, the Customer must return the product(s), together with the completed return slip. The customers’ bank account will be credited for the amount corresponding to the number of items returned within 7 days following receipt of the parcel by TY BOLID.

Article 11. Responsibility and legal guarantees

The products offered on the Website comply with French law. The photographs illustrating the products are for illustrative purposes only and are not contractual. It is recommended the Customer view the details of each product in the catalogue. In case of an error in one of the photographs, texts, etc., TY BOLID cannot be held responsible. In case of doubt, or any questions, the customer is welcome to contact TY BOLID via the "Contact Us" tab. In case of product unavailability, shipping strikes or force majeure, TY BOLID cannot be held responsible.
 
In accordance with the Articles L.211-4 L.211-14 of the Consumer Code and 1641 to 1648 of the Civil Code, TY BOLID is required to deliver the agreed product and must answer for any lack of conformity or hidden defects which could be established after delivery. In case of non-compliance, the customer should return the product in order to be reimbursed. In case of hidden defects, TY BOLID will reimburse the product concerned, subject to TY BOLID being notified by the Client within 7 days from the delivery date.

Article 12. Copyright and personal date protection

The use of the Website and its services is for personal use only. In accordance with laws governing copyright and ownership of literary and artistic rights, any text, graphics, images, photographs, drawings, logos, comments ... present on the site www.ty-bolid.com, are the exclusive property of TY BOLID or its suppliers and any total or partial reproduction is strictly prohibited. Furthermore, TY BOLID undertakes to respect the confidentiality of customers’ personal data after they have filled in their Customer Account, or at any time during the order process. 

Article 13. Ownership rights

Any products purchased on the website remain the exclusive property of TY BOLID until full payment is received.

Article 14. Litigation

In cases where the dispute cannot be settled amicably, the Commercial Court in Vannes has exclusive jurisdiction regardless of the conditions of sale and payment, as expressly accepted by the customer. Products and obligations of the parties shall be exclusively governed by French law.
